1. Acceptance of these Terms
These Terms of Use ("Terms") govern your access to and use of the pre-launch website at https://www.artino.in (the "Site"), operated by Aratuza Private Limited ("Aratuza", "we", "us"). By accessing the Site or joining the waitlist, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Eligibility
You must be 18 years of age or older and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Site and join the waitlist.
3. Nature of the Site — important
- The Site is informational only and exists to describe some of Artino's planned features and to collect waitlist registrations.
- No service, listing, booking, transaction, or payment is offered, made, or processed through this Site. Artino's marketplace, social, and booking features are not yet live.
- Any features, timelines, or descriptions shown are plans that may change, be delayed, or be discontinued at our sole discretion.
- Joining the waitlist does not guarantee access to Artino, any particular priority, pricing, feature, or that the app will launch at all. It creates no contractual obligation on us to provide any service.
4. Your waitlist submission
When you join the waitlist, you agree to provide accurate and current information and that we may contact you about Artino in accordance with the Privacy Policy. You are responsible for the information you submit.
5. Intellectual property
The Site and its contents — including the Artino and Aratuza names, logos, text, graphics, design, and other materials — are owned by or licensed to Aratuza and are protected by Indian and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to view the Site for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, scrape, or create derivative works from any part of the Site without our prior written permission.
6. Acceptable use
You agree not to: (a) submit false, misleading, or another person's information; (b) use any automated means (bots, scrapers, crawlers) to access or harvest data from the Site; (c) attempt to gain unauthorised access to, interfere with, or disrupt the Site or its security; or (d) use the Site for any unlawful purpose or in violation of these Terms.
7. Third-party links
The Site may contain links to third-party websites (for example, our social media pages). We are not responsible for the content, policies, or practices of those third parties.
8. Disclaimers
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including as to accuracy, availability, or that planned features will be delivered as described. Forward-looking statements about Artino are not promises.
9. Limitation of liability
To the fullest extent permitted by applicable law, Aratuza and its directors, officers, and employees will not be liable for any indirect, incidental, special, or consequential loss arising out of or in connection with your use of (or inability to use) the Site or your waitlist registration.
10. Indemnity
You agree to indemnify and hold Aratuza harmless from any claim or demand arising out of your breach of these Terms or your misuse of the Site.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Changes to these Terms
We may modify these Terms at any time by posting the updated version on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, the courts at Jaipur, Rajasthan will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Site.
